Herbal products for smoking
In Sweden, herbal products for smoking are regulated by the Act on Tobacco and Similar Products. This legislation regulates for example reporting of ingredients, labelling requirements and smoke-free environments.
What is an herbal product for smoking?
An herbal product for smoking means a product based on plants, herbs or fruits which contains no tobacco and that can be consumed via a combustion process.
Products that are not classified as herbal products for smoking
The following products are not classified as herbal products for smoking according to the Act on Tobacco and Similar Products:
- Herbal product for smoking classified as a narcotic drug or a substance harmful to health. These products are regulated by the Penal Law on Narcotics or the Prohibition of Certain Goods Dangerous to Health Act.
- Hexahydrocannabinol (HHC) is covered by the Penal Law on Narcotics.
The Swedish Medical Products Agency considers that:
- Tetrahydrocannabinol (THC) is covered by the Penal Law on Narcotics.

Market surveillance and supervision of herbal products for smoking
Only herbal products for smoking that comply with the Act on Tobacco and Similar Products may be available on the Swedish market. Please note that this also applies to herbal products for smoking intended for free circulation entering the European Union market.
A market surveillance or supervision authority can decide on an injunction or prohibition, with or without a fine, if a non-compliant herbal product for smoking is available on the Swedish market.
